    • Any equipment built-to-order or modified to customer specifications

3. Shipping, Freight, and Delivery

  • Geographic Coverage: We ship products all over the United States and worldwide.

4. Limitation of Liability

  • Inventory Scope: While American Tech Supply offers access to over 300,000 telecommunications products, we do not guarantee immediate stock on all items.
  • Consequential Damages: American Tech Supply is not liable for any project delays, labor costs, or consequential damages resulting from delayed lead times, incorrect orders, or carrier transit issues.

Payments for product for International Orders must be made by wire transfer, Letter of Credit, or made by USa based BUSINESS, a USA based address and USA Based Credit Card. Our proper forms must be first filled out before shipment is made.

8. Customer or purchaser ATS Products is responsible for ALL SALES and or “use” TAXES-outside of California and Florida. Until further notice -ATS does not have to collect sales tax from a customer unless we have a physical presence in that particular state. THIS APPLIES TO ALL FIBER OPTIC CABLE, PATCH CABLES, TELECOMMUNICATIONS EQUIPMENT & HARDWARE, CABINETS, ETC., OR ALL PURCHASES THAT ARE SPECIAL ORDERED. UNFORTUNATELY THERE ARE NO ALTERNATIVES TO THIS STIPULATION- AS ONCE ATS ORDERS EQUIPMENT FROM ONE OF OUR SUPPLIERS- WE TOO CANNOT RETURN IT. THANK YOU FOR YOUR UNDERSTANDING.

Upon receipt of each CUSTOM ORDER- American Data Supply, DBA American Teledata.com verifies that this is a NON- RETURNABLE ITEM. For custom patch cords, fiber optic assemblies, etc., we have to advise our customers that unless the product is defective- there are NO RETURNS. American Data Supply, DBA American Teledata.com TESTS and VERIFIES that each and every cable that leaves our warehouses MEET OR EXCEED EIA-TIA 568-A/B cable specifications. If you are unsatisfied with an ‘appearance’ or cosmetic issue’-yet if the product meets the criteria that the cable was designed for(IE SPECIFICATIONS DETERMINED BY THE EIA AND THE TIA– there will BE ONLY ONE SOLUTION.

We have a MINIMUM 30% -RE-STOCKING CHARGE FOR SOME CATEGORY CABLES.  CUSTOM CABLES ARE NOT RETURNABLE- PLEASE INQUIRE FIRST FOR OUR TERMS WHEN ASKING YOUR REPRESENTATIVE-AND CUSTOMER MUST PAY THE FREIGHT FOR THE OUTBOUND AND INBOUND (RETURN) SHIPMENTS. PLEASE READ THESE TERMS AND CONDITIONS OF SALE (“SALE AGREEMENT”) VERY CAREFULLY.

THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH ATS, Inc. (DBA) ATS, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).

Important information about this legal contract: This Sale Agreement is a legal contract between the Customer and ATS, Inc. (DBA) ATS. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on ATS’s website. (References to “you” or “your” shall relate to the Customer; references to “ATS” shall relate to ATS, Inc. and its affiliates.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on ATS’s website at the time the Customer initially places or modifies an order will govern the order in question.

This Sale Agreement constitutes the entire agreement between the Customer and ATS relating to the purchase or sale of goods or services. Governing Law: THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF Florida or WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN CALIFORNIA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.

Title / Risk of Loss: Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by ATS is ATS’s responsibility. Loss or damage that occurs during shipping by a carrier selected by Customer is Customer’s responsibility. Title to software will remain with the applicable licensor(s).

TAXES: The sale(s) price does not include any amount for present or future sales tax. Sales tax or excise tax is the responsibility of the buyer and may be added to the purchase cost of goods, where applicable.

Installation: Buyer agrees to pay for all installation charges. ATS is not to be held responsible for claimed or unclaimed installation fees on any of its products ATS sells.

Export Sales: If goods herein being purchased are being purchased for purposes of export, the Customer must obtain from the federal government certain export documentation before shipping to a foreign country. In addition, manufacturers’ warranties for exported goods may vary or even be null and void for goods exported outside the United States. The Customer should inquire further regarding any questions. Any and all liability is only for the products purchased.

General Legal Disclaimer: ATS HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY ATS IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER\’S WARRANTY, IF ANY.

Arbitration: ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) arising from or relating to this Sale Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Sale Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Sale Agreement), ATS’s advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (NAF) under the Code of Procedure of ARBITRATION-FORUM.COM (the “Code”) in effect at the time the claim is filed. The Code is available at http://www.arbitration-forum.com or can be obtained by calling 1-800-753-9448. Notwithstanding any choice of law provision included in this Sale Agreement, this arbitration agreement is subject to the Federal Arbitration Act (9 U.S.C. §§ 1-16) and the New York Convention on the Enforcement of Arbitration Awards (9 U.S.C. §§ 201-208 or as codified in the jurisdiction where enforcement of the award is sought). Hearings shall be held as provided by the Code and if any In-person Hearing is required, it shall be held in Riverside County, California. Judgment on the award rendered by the arbitrator(s) may be entered by any court having jurisdiction. Each party shall bear its own cost of any legal representation, discovery, or research required to complete arbitration.

Orders, Payment Terms, Interest, Taxes: Orders are not binding upon ATS until accepted by ATS. Terms of payment are within ATS’s sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. ATS may invoice parts of an order separately. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order.

Freight Policy: Shipping and handling charges on all orders vary, depending upon published rate of the carriers used. Contact your ATS account manager for our most current and competitive rates, options and shipping specials. For the Customer’s protection, we ship only to the verified billing address of the Customer\’s credit card. In some circumstances, international shipping may be available. Call for details.

The express warranties herein contained are in lieu of any and all other warranties, expressed or implied, As to any matter whatsoever, and seller hereby disclaims such warranties, including, without limitation, any warranty relating to the design, quality or condition of the equipment, its merchantability, fitness, or capacity for any particular purpose, non-infringement, and warranties arising from course of dealing or usage of trade or any other matter.

Return Policy

* DEFECTIVE goods may be returned to ATS within 30 days from ATS Cable’s invoice date, at ATS’s discretion we will approve one of the following: credit, exchange, replacement, or repair. All goods returned must have a RMA number assigned and issued by ATS and clearly marked on the outside of the package being returned.

* Please call (866) 342-3721 or e-mail our Returns Department at rma@primuscable.com to obtain a Return Merchandise Authorization (RMA) number prior to returning or shipping your product back to ATS. NO returns of any type will be accepted without an RMA number. For faster service, please have the following information on hand when calling for an RMA number: customer name, invoice number, serial number and nature of the problem.

* Any items being return not in its original package will be returned and under no circumstance will we issue a credit. All products returned MUST be 100 percent complete, contain ALL original boxes and packing materials, have original UPC codes on the manufacturer boxes, contain all manuals, blank warranty cards and other accessories and documentation provided by the manufacturer.

* You are responsible for shipping charges on returned items; ATS will return the item(s) being repaired or replaced via UPS Ground at our expense. Any additional shipping cost(s) is your responsibility.

* ATS strongly recommends you fully insure your return shipment in case it is lost or damaged and you use a carrier that can provide you with proof of delivery for your protection.

* If merchandise arrives to you damaged: it is best to REFUSE it back to the delivery carrier. If you accept the package make sure it is noted on the carrier’s delivery record in order for ATS to file a damage claim. Save the merchandise AND the original box and packing it arrived in, notify ATS immediately to arrange for a carrier inspection and a pickup of damaged merchandise. If you do not notify ATS of damaged goods within the first 15 days of arrival, our regular return policy will override any claim of damage and will fall under all current manufacturer restrictions. Call (866) 342-3721 or your ATS account manager to arrange for carrier inspection and a pickup of damaged merchandise.

* Manufacturer restrictions do apply and are outlined in our detailed policy. Any item(s) that are missing the UPC Code can ONLY be replaced with the same item. After 30 days, all manufacturers’ warranties apply.

* NON-DEFECTIVE returns can be accepted directly by ATS within 30 days from the invoice date, at ATS’s discretion for: credit, exchange. All NON-DEFECTIVE returns are subject to a MIMUMUM 20 percent restocking fee.

ATS reserves the right to authorize product returns beyond 30 days from the invoice date. If the product(s) is accepted after 30 days, credit will be issued toward FUTURE PURCHASES ONLY. Original shipping charges are not refunded on returned items. Customers are responsible for all shipping charges back to ATS on returned items, and ATS Cable will pay the shipping charges on the replacement or exchange item(s) going back.

Check Payment Policy: ATS will accept a cashiers check or money order on all COD orders. COD Company check terms are available upon completion and acceptance of a ATS credit application. Email us at support@americanteledata.com. Payments not made on time for invoices do are subject to a 1.5% late penalty. ATS will accept personal and business checks for prepay orders, may take up to 10 business days to clear.
